This User Agreement ("Agreement" or "User Agreement") is a contract between you and Payko, Inc. and applies to your use of the Payko® payment service and any related products and services (collectively the "Service"). This Agreement affects your rights and you should read it carefully. We encourage you to print the Agreement or copy it to your computer's hard drive for your reference. Help Center. In this Agreement, "you" or "your" means any person or entity using the Service ("Users"). Unless otherwise stated, "Payko," "we" or "our" will refer collectively to Payko, Inc. and its subsidiaries, affiliates, directors, officers, employees, agents and contractors.
By clicking "I Agree", "I Accept"; or by submitting payment information through the Service you agree to the terms and conditions of this Agreement, the Payko Privacy Policy, and any documents incorporated by reference. You further agree that this User Agreement forms a legally binding contract between you and Payko, and that this Agreement constitutes "a writing signed by You" under any applicable law or regulation. Any rights not expressly granted herein are reserved by Payko, Inc. This Agreement is subject to change by Payko without prior notice (unless prior notice is required by law), by posting of the revised Agreement on the Payko website. 1. PayPal.com account holder.
As a buyer of a money order from Payko.com, you agree that all payments from your PayPal.com account to purchase a money order from Payko.com are final and non-reversible once the money order purchased has been mailed. You agree that Payko.com "just sells" money orders and is not responsible for the transaction the money order is paying for. As a buyer you understand once a money order is sent by Payko.com, that the money order cannot be stopped and that you take full responsibility once the money order is mailed.
2. Disputes between buyers and sellers of Payko.com.
As a customer, you agree that you are fully responsible for any goods or services purchased using the services of Payko.com. You agree that Payko.com "just sells" money orders and is not responsible for the transaction the money order is paying for. You agree the money order purchase from Payko.com is final and non-reversible. You also agree that any dispute that arises between you, the buyer and a seller, including disputes about the products and services purchased are not the responsibility of Payko.com.
3. Internet sites with Payko.com's banner.
Payko.com is not responsible for any website's content using its banner.
4. Stolen or fraudulent money orders.
Purchaser of money order agrees, that any money order sent by Payko.com that is stolen or fraudulently cashed, assumes all liability and agrees to hold Payko.com with NO liability.
5. Refusal of service.
Payko.com reserves the right to refuse service to anyone or any user of its services at any time. Payko also reserves the right to require a faxed photo ID in certain cases where it is deemed fit. US Patriot ACT requires close monitoring of all financial transactions and Payko adheres to all these regulations.
6. Refunds
Payko.com cannot stop payment nor issue refunds once a money order draft is made. To obtain a refund, contact the recipient. In the event of a lost money order in mailing, the sender will be responsible to file a refund request with Travelers Express. The cost of refund on a lost money order is determined by Travelers Express and is the responsibility the sender.
7. Applicable law
By using Payko.com, you agree that the laws of the state of Delaware, without regard to principles of conflict of laws, will govern this Service Agreement and any dispute of any sort that might arise between you and Payko.com or its affiliates.
8. Site policies, modification, and server availability
Please review our other policies posted on this site. These policies also govern your use of Payko.com. We reserve the right to make changes to our site, policies, and this Service Agreement at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
9. Payko.com Responsibilities
Payko.com will attempt to process your order in a timely manner. Payko.com shall not incur any liability because we couldn't or wouldn't process your order for any reason. Payko also cannot be held liable for any payments that are placed with our payment processors. In the event that payment is not received by Payko for your purchase from said processor, Payko will not be held liable to fulfill orders originating from this payment.
10. Caveat - No Warranty "AS IS"
PLEASE BE AWARE AND ADVISED, PAYKO.COM PROVIDES ITS WEB SITE AND SERVICES "AS IS" AND WITHOUT ANY WARRANTY OR CONDITION, EXPRESS, IMPLIED OR STATUTORY. PAYKO.COM FURTHER SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT FOR THE SERVICES ASA PROVIDED OR FOR ANY TRANSACTION. WE ASSUME NO RESPONSIBILITY FOR THE UNAVAILABILITY OF THIS SITE. UNLESS DISCLAIMED SUCH WARRANTIES IS PROHIBITED BY LAW.
11. Non-Responsibility.
IN NO EVENT SHALL PAYKO.COM BE LIABLE FOR ANY LOST PROFITS OR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF, RELATING TO, OR IN CONNECTION WITH, DIRECTLY OR INDIRECTLY, OR INTENTIONALLY OR NEGLIGENTLY, THE USE OF PAYKO's SITE, SERVICES OR THIS AGREEMENT.
12. Modifications to service
You agree that Payko.com shall not be liable for any modifications it makes to its site. Payko.com reserves the right at any time to modify or discontinue, temporarily or permanently the service or any part of the service with or without notice.
13. Hours Of Operation
All processing times displayed on the website adhere to Payko.com business schedule. Payko.com hours of operation are Monday through Friday 9:00am-5:00pm EST excluding legal banking holidays. All orders received after these hours will be processed on the following business day.
